Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CreatorAssets.ai (the “Service”), operated by CreatorAssets (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for the accuracy of the information you provide and for all activity under your account. Keep your credentials confidential and notify us immediately of any unauthorized use.

2. The Service

CreatorAssets.ai uses large language models and image-generation models to produce social media content based on prompts and assets you provide, and allows you to schedule and publish that content to connected third-party platforms (such as Meta Facebook and Instagram). The Service is provided on a subscription or credit-pack basis as described on our pricing page.

3. Acceptable use

You agree not to use the Service to:

• Violate any law or the terms of any connected platform (including Meta’s Platform Terms and Community Standards).
• Generate or publish content that is unlawful, defamatory, harassing, hateful, sexually explicit involving minors, or that infringes anyone’s intellectual property or privacy rights.
• Impersonate another person or entity, or misrepresent your affiliation.
• Spam, phish, distribute malware, or run automated posting campaigns designed to manipulate platform algorithms.
• Reverse engineer, scrape, or attempt to extract our models or source code.
• Resell or rebrand the Service without our written permission.

We may suspend or terminate your account if we reasonably believe you have violated these rules.

4. Your content

You retain ownership of the prompts, brand assets, images, and other material you provide (“User Content”). You grant us a worldwide, royalty-free license to host, process, and transmit User Content solely to operate and improve the Service for you — including sending it to the AI providers and social platforms we integrate with.

You represent that you have the rights necessary to upload your User Content and that publishing it will not violate any third party’s rights.

5. AI-generated output

Subject to your compliance with these Terms, we assign to you all rights we may have in the content the Service generates for you (“Generated Output”). You are responsible for reviewing Generated Output before publishing it. AI models can produce inaccurate, biased, or infringing results; we make no warranty that Generated Output is accurate, original, or suitable for any purpose.

6. Third-party platforms

When you connect a Facebook or Instagram account, you authorize us to use the access tokens Meta provides to publish content at your direction. Your use of those platforms remains subject to their own terms. We are not responsible for outages, policy changes, or content enforcement actions by third-party platforms.

7. Fees and billing

Paid plans renew automatically at the interval shown at checkout until you cancel. Credits do not expire unless explicitly stated on the pricing page. We may change prices on 30 days’ notice. Except where required by law, payments are non-refundable.

8. Termination

You may cancel your subscription or delete your account at any time from your account settings. We may suspend or terminate the Service, or your access to it, if you breach these Terms, if we need to protect the Service or other users, or if we discontinue the Service. On termination, your right to use the Service ends immediately.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, CreatorAssets and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100.

11. Indemnification

You will defend, indemnify, and hold harmless CreatorAssets from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction there.

13. Changes

We may update these Terms from time to time. If a change is material, we will notify you by email or in-app at least 14 days before it takes effect. Continued use after the effective date constitutes acceptance.
